What’s a 66W when buying a property?

Your offer on a property has been accepted, and the agent wants you to sign a 66W? What does this mean? What are you signing? Basically, you are signing a document that waives your right to rescind the contract.

Generally, when you sign a contract, you have the option to have a 5 or 10 ‘cooling-off period’. This means if you choose not to proceed with the purchase of the property, you only lose the 0.25% deposit, not the full 10%.

Once the 10% has been paid, then you are committed to that property, no matter what. If you don’t proceed, you may lose your full 10% deposit.

Here are the things you need to do during the ‘cooling-off period’ so you don’t lose your hard-earned money

Obtain formal approval from your lender

Now is the time your lender will carry out a valuation on the property and formalise your approval. The lender will assess the property and once deemed acceptable they will issue a formal approval. Basically, giving you the final tick of approval.

Obtain a pest and building report

An independent professional will assess the property and ensure there is no threat of pest, e.g., termites on the property. They will also report on the structure of the property. They will do a thorough assessment of the property to report on the structure of the property. This is a must for anybody purchasing a property that's not under a strata scheme, as any structural issues or damages will then become your problem. When signing the contract, you agree to buy the property as it is, even if there is dodgy or non-compliant works on the property.

Have your contract reviewed by a solicitor

Anyone can put anything into a contract, if you sign it, then that constitutes your agreement to what's listed in the contract. The contract should be reviewed by a solicitor, especially before you go to auction on a property, to ensure there are no nasty surprises. Your solicitor will advise you on the risks of the contract and may even request changes to the contract to make it more fair for both parties. Your solicitor will also help with facilitating the deposit payment and settlement of the property.
